Americans with Disabilities Act (ADA) Review

Americans with Disabilities Act (ADA) Review.  Conformance with ADA Design Standards is a requirement under Federal Law. To protect the investment property owner’s make in the city, and to promote accessibility within the city, the City of Davenport supports compliance with ADA Standards in private* new construction and building alterations as applicable to standards identified in ADA Title II and Title III. 

The City has adopted the most current International Building Code (IBC) and Iowa SUDAS with City Supplemental Specifications.  Chapter 11 of IBC addresses accessibility, ADA Title II and III may have additional requirements and supersedes in any instance of duplication between the standard and the code.  ADA Title II and III may have additional requirements and may also supersede any instance of duplication in Iowa SUDAS with City Supplemental Specifications.

It is a property owner’s responsibility to comply with ADA Design Standards when applicable.  The City is not liable for any ADA non-compliances issues a property owner may incur. 

*The City of Davenport has all applicable city owned facilities and infrastructure reviewed for ADA compliance prior to construction.

Developers and contractors are required to select one of the following when submitting plans to the City of Davenport.

  1. I certify these plans have been reviewed by a licensed architect for conformance with current ADA standards for accessible design.
  2. These plans have not been reviewed for conformance with ADA standards for accessibility.  I would like to have these plans reviewed for ADA compliance through a third-party contract with the City of Davenport, and understand that the costs associated with such review will be invoiced to me or my agency as applicable. (See Fees Below)
  3. These plans have not been reviewed for conformance with ADA standards for accessibility. I elect not to have these plans reviewed for compliance with ADA standards for accessibility. I believe the plans submitted are for new construction or alternations to an existing facility that do not fall under ADA Title II or II requirements and/or that the work to be performed does not affect the usability of the primary function area(s) as defined in ADA standards.
